Definitions And Interpretations
In these terms and conditions: Reference to “we” and “us” is a reference to VIET PRODUK. Reference to “you” is a reference to the purchaser of the Goods from us. “Contract” means the contract between us for the sale and purchase of the Goods which incorporates these Terms & Conditions. “Goods” means the garments and other items purchased by you from us. “Terms” means these terms and conditions. These Terms are the only terms and conditions on which we contract for the sale of Goods and they form an integral part of the Contract between us. If we agree to vary any of the terms, the variation must be in writing confirmed by our duly authorized representative and by you.

Price
The price of Goods quoted on our website includes VAT (Value Added Tax). Where VAT is not included in the price, it will be added and payable by you at the appropriate rate. Prices displayed on the Site are shown in Rand, including VAT. Prices are subject to change at any time without notice.

The price lists are in ZAR (South African Rand), to convert the price to your currency,  ask us directly. info@vietproduk.co.za. Prices are subject to change due to the fluctuations in the precious metal and gemstone market.

Ordering Goods Online
You warrant to us that all information which you are required to provide when ordering Goods online is accurate and complete in all respects at the time of the order and that this information relates to you/the person placing the order and not to any third party. When an order is made online, the order confirmation issued by the company clearing the credit/debit card payment does not constitute acceptance of your order by us. We reserve the right to check any discrepancies and an order will only be confirmed when it is verified by us. Any error in any ordering process due to technical or other reasons beyond our control entitles us not to treat the order as being binding on us. When you order a Product from our website you are offering to buy it at the price stated, subject to these terms. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information were entered onto the system. We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following: The product ordered being unavailable from stock. Our inability to obtain authorisation of payment. The identification of an error within the product information, including price or promotion. Order acceptance and cancellation. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason, whether or not your credit card has been charged. If your credit card has been charged and your order is cancelled, you will receive a refund. Once an order has been placed, it cannot be cancelled unless the shipment is unavoidably delayed. In this case, we will do our best to cancel the order if requested.

Back ordered items
When the item you purchased is currently out-of-stock, manufacturing time will need to be added to the waiting period. Manufacturing time is normally 4-7 weeks depending on the item. Please be aware that dates are approximate and are subject to change.

Changes In Products And Pricing
We are constantly updating and revising our offerings of products, and we may discontinue products at any time without notice. All pricing for our products is subject to change. For all of our prices and products, we reserve the right to make adjustments due to changing market conditions, currency fluctuations, product discontinuation, manufacturer price changes, errors in advertisements, and other extenuating circumstances

Privacy
If you place an order, you will have to provide personal information to us. We will not disclose that information to any third party without your consent, except for the purpose of processing the order and arranging delivery. We do not store our customer’s financial details.

Payment
All payment for Goods and for the cost of packaging and delivery must be made before the Goods are delivered. Payment online will be made by PayFast using a Debit/Credit card or by EFT (Electronic Funds Transfer)

Delivery
An additional rate will be charged per parcel for courier depending on what the address is. If you live in a remote area increased costs may occur. Please note that we cannot deliver to a Postal Box and thus a physical address is necessary for shipping within South Africa. Please provide detailed and correct contact information, should a product be returned to us due to incorrect delivery information additional shipping costs will be incurred. Purchases are only shipped once payment has been made in full. Items will be dispatched within 48 hours after receipt of payment. Delivery in South Africa can take from 3-7 working days depending on where it is sent . You must notify us promptly and in any event within 48 hours or receipt of any Goods if they appear to be damaged in transit. In those circumstances, you must also keep all packaging as this may be required when making a claim.

Advertising Disclaimer And Trademarks
We attempt to be as accurate as possible with product descriptions and prices. However, we do not warrant that product descriptions or prices are accurate. In the event that a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers and brands, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge. We apologize for any inconvenience this may cause you. If you are not completely satisfied with your purchase, you may return it in accordance with our Return Policy, as set forth below.

Returns
If you wish to return an item then you should email us at info@vietproduk.co.za to notify us of the return within 7 days of receiving the goods. You should make it clear if you require an exchange, credit note or refund for the item.

Any items returned without prior notice in writing will not be accepted.
You must take reasonable care of all Goods in your possession and return them to us, appropriately packaged to avoid damage, within 7 days from the cancellation date. We reserve the right to arrange collection, in which case you will be responsible for collection charges. We will refund the purchase price to you within 30 days of the cancellation notice but we reserve the right to charge a restocking fee and any other costs we incur in connection with the return of the Goods. In the case of Goods which are made and supplied to your specification or which have been personalized for you, you will not have the right to cancel the Contract. Items should be returned in their original packaging to ensure they are adequately protected in transit. Items should be returned new, unused, and with all the tags still attached. Returns that are damaged or soiled will not be accepted and may be sent back to the customer.

Faulty Goods
Goods are classified as faulty if they are received damaged, or where a manufacturing fault occurs within one month of purchase. Please note that items that are damaged as a result of wear and tear are not considered to be faulty. If you would like to exchange a faulty item, please be aware that we can only replace it for the same product in the same colour and style, subject to availability. Where possible, we will offer to repair faulty items

Late Returns
Goods returned outside of the above time frames will not accepted and will be returned to the customer.

Risk And Ownership
12.1 The risk of loss or damage to Goods passes to you upon delivery.

12.2 Ownership in all Goods remains with us until full payment of all amounts due to us have been received from you.

12.3 You will be responsible for the safe custody and insurance of all Goods in your possession.

12.4 You have no right to re-sell any Goods until payment has been received in full by us.

Warranties And Liability
13.1 We warrant to you that the Goods ordered by you will meet the description as shown on our website (or any other description given to you in writing).

13.2 We will not have any responsibility for any damage which occurs to the Goods after delivery.

13.3 If any defect in any Goods appear within a month of delivery, you must notify us as soon as you become aware of the defect, giving us full details. We will then decide, in consultation with you, whether the defect is our responsibility. If so, we may arrange either to repair the Goods or to replace them with similar Goods. Any defective Goods to be returned to us must be returned at your expense.

13.4 We do not accept any responsibility for any wear and tear, accidental damage or failure by you or by any third party to adhere to any written recommendation provided in relation to the Goods.

13.5 Liability to you for loss or damage under no circumstances must exceed in the total amount you have paid us for those Goods. (However, we acknowledge that we cannot exclude legal liability for death or personal injury which is proved to be due to our negligence).

Notices
If you wish to give us any notice relating to a matter covered by these Terms, whether you telephone us or not, you must confirm that notice in writing. In the case of email notices, these should be sent to info@vietproduk.co.za and you must send them so as to return an acknowledgement of receipt.

Disputes
If there is a dispute which we cannot settle by direct negotiation it may be referred to mediation if agreed between us. Any dispute between us will be finally determined by the South African courts and you agree to submit to the jurisdiction of those courts.
